Director of the Federal Bureau of Investigation (FBI), Kash Patel, has filed a defamation lawsuit against The Atlantic following the publication of an article that accused him of excessive drinking, and misconduct.

The lawsuit, filed in a U.S. federal court, seeks $250 million in damages and names both the magazine and journalist Sarah Fitzpatrick as defendants. According to court filings, Patel described the report as a “malicious and defamatory” piece intended to damage his reputation and force him out of office.

The article in question, published on April 17, cited more than two dozen anonymous sources who alleged that Patel engaged in “excessive drinking” and had unexplained absences that disrupted FBI operations. It further claimed that meetings were delayed due to his alleged behaviour and that he was sometimes unreachable for critical decisions.

Patel has strongly denied the allegations, insisting the claims are entirely false. He accused the publication of ignoring official denials from himself, the FBI, and other government bodies prior to publication.

“The Atlantic’s story is a lie,” Patel said, maintaining that the outlet was provided with accurate information before publishing the report but chose to proceed regardless.

His legal team argues that the magazine acted with “actual malice,” a key standard required in the U.S. defamation cases involving public officials, by allegedly publishing unverified claims based largely on anonymous sources.

In response, The Atlantic has defended its reporting, stating that it stands by the story and will vigorously contest the lawsuit.

Legal experts note that defamation suits brought by public figures in the United States face significant challenges, particularly the need to prove that a publication knowingly published false information or acted with reckless disregard for the truth.
