CNN, MS NOW, Politico Urge Judge to Permanently Block White House Ban

CNN, MS NOW and Politico have returned to a federal court in Washington to ask a judge to prevent the White House from reinstating a ban on their journalists, escalating a legal battle over press access and constitutional protections.

The three news organisations appeared before US District Judge Timothy Kelly on Thursday, October 8, seeking a longer-term injunction after the judge temporarily blocked President Donald Trump’s order and restored their access to the White House in September.

Trump announced the ban in September, accusing CNN, MS NOW and Politico of publishing what he described as “fake news.” The administration later argued in court that the outlets had published material that could affect national security, including information it characterised as classified or sensitive.

The media organisations dispute that justification. Their lawyers argue that the White House is retaliating against the outlets because of reporting that the administration dislikes and that using government access to punish particular news organisations violates constitutional protections.

In a filing ahead of Thursday’s hearing, the outlets argued that the administration had provided no new evidence establishing that their reporting endangered national security. They also pointed to continued restrictions against their journalists, including the White House’s decision to prevent Politico from joining President Trump’s Air Force One trip to Nebraska earlier this month.

Judge Kelly had already intervened in the dispute on September 24, ordering the White House to restore the journalists’ credentials for 14 days while the case proceeded. He said the outlets were likely to succeed on their claim that the administration had failed to provide the due process required before revoking their access.

The Justice Department, however, is asking the court to allow Trump to reinstate the restrictions. Government lawyers argue that access to the White House is a privilege rather than an unrestricted right and that the president needs flexibility to act quickly when national-security concerns arise.

The administration has also challenged the legal precedent governing journalists’ access to the White House. During earlier proceedings, Kelly questioned whether the administration had followed established procedures before taking away the reporters’ credentials. The judge noted that previous court decisions require journalists to receive appropriate notice and an opportunity to respond before their access is revoked.

The dispute has drawn wider attention from press organisations and other media outlets, which have warned that allowing a president to exclude particular news organisations because of their coverage could establish a precedent affecting journalists beyond the three companies involved in the case.

The White House has maintained that its actions are justified by its concerns about national security and the conduct of the affected organisations. CNN, MS NOW and Politico, meanwhile, argue that the restrictions amount to retaliation for their journalism.

The case comes as the United States approaches the November 3 midterm elections, increasing the significance of disputes over journalists’ access to the president and the federal government.

Judge Kelly’s decision on the request for longer-term protection will determine whether CNN, MS NOW and Politico can continue reporting from the White House while the broader lawsuit proceeds, or whether the administration will regain the ability to enforce its ban.
